Who sells
Valment Partners Inc., 3426 Liptay Ave, Oakville L6M 0M8, Ontario, Canada — contact@valment.com. Valment sells seats on training courses. The courses, examinations and certificates are the products of the certification body named on each course page; Valment supplies the seat and assigns it in that body's systems. Valment certifies no one.
Where we sell
This store offers its products only to buyers in Canada, the United States and Switzerland. We do not offer or direct this store to buyers elsewhere, including the European Union and the United Kingdom. An order identified as placed from outside these countries will be cancelled and refunded in full before any course is assigned.
What you buy
One seat is one named learner on one course, including the examination stated on the course page. Team bundles are the seats listed in the bundle. Purchase does not guarantee passing the examination or certification; the certification body examines and certifies independently.
Prices and tax
Prices are shown per seat, in the currency shown on the page — US dollars, Canadian dollars or Swiss francs. The currency you see is the currency you are charged. Prices shown in Swiss francs include any Swiss value-added tax. For prices shown in US or Canadian dollars, any sales tax Valment is required to collect is shown as a separate line at checkout, before you pay, and added to the total. Where no tax line is shown at checkout, no tax is added: the total shown before you pay is the total you are charged. Your order confirmation shows what you paid, with any tax shown separately.
The address you give
By placing an order you confirm that the billing address you give is your address of residence or your place of business.
How the seat is delivered
After payment you name the learner for each seat. Valment then assigns the course to the learner's account with the certification body, which sends the learner a confirmation email once the course is assigned. The training material and the examination instructions are accessed in the learner's dashboard with the certification body after signing in; neither is sent to the learner by email. Valment assigns the course within one business day of your naming the learner. For some courses, the certification body must first activate the course on Valment's partner account; where that applies, assignment may take up to five business days from your naming the learner. Until the seat is assigned, you may cancel on request as described under Refunds.
Refunds
Until a seat is assigned, you may cancel it on request. We refund the amount you paid for that seat, less a processing fee of 4.5% of that amount. The fee covers the payment-processing cost of your original payment, which the payment processor does not return to us when a payment is refunded. A refund includes any tax charged on the amount refunded. The fee does not apply where we cancel your order (see Where we sell) or where we cannot deliver what you bought, and it does not limit any right a law gives you to cancel and be refunded in full. After a seat is assigned, see the refund page. [Part 13.1 model amended by Part 20; the after-assignment paragraph stays bracketed until the certification body's end-user cancellation policy is on file.]
Business buyers
Invoices and purchase orders for teams are available through the quote form. The processing fee described under Refunds applies to orders placed under a quote unless the quote states otherwise.
Liability (business buyers)
For purchases made in the course of a trade or profession: Valment's total liability arising out of or in connection with an order is limited to the amount paid for that order, and Valment is not liable for indirect or consequential loss, loss of profit, loss of business or loss of data. This does not limit liability for fraud or wilful misconduct, or any liability that cannot be excluded by law. This section does not apply to consumers.
Law and disputes
These terms and any purchase from this store are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. Disputes may be brought in the courts of Ontario; this choice of forum is not exclusive. If you are a consumer, nothing in these terms takes away rights or protections you have under mandatory law where you usually live — including your consumer protection and data protection law — and nothing prevents you from bringing a claim in your home courts where that law allows it. Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law.
